Terms of service

Effective Date: June 30, 2026

These Terms of Service (“Terms”) govern your access to and use of fortahealth.com and related online content and forms (the “Site”), operated by Montera, Inc. doing business as Forta (“Forta,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

These Terms govern your use of the Site only. ABA therapy and related clinical services are provided under separate clinical, consent, and financial-responsibility agreements (“Service Agreements”) that you enter into during intake and onboarding. If these Terms conflict with a Service Agreement regarding services, the Service Agreement controls.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site. Parents and legal guardians may use the Site to seek services on behalf of a child.

2. Not Medical Advice; No Provider Relationship via the Site

Content on the Site is for general informational purposes only and is not medical, clinical, or professional advice, diagnosis, or treatment. Using the Site, submitting a form, or communicating with us through the Site does not by itself create a clinician-patient relationship. Always seek the advice of a qualified healthcare provider with questions about a medical condition. In an emergency, call 911 or go to the nearest emergency room.

3. No Guarantee of Outcomes

ABA therapy outcomes vary by individual. Statistics, research summaries, and testimonials on the Site describe general or past results and are not a promise or guarantee of any particular outcome for your child.

4. Insurance & Coverage

Insurance and Medicaid coverage varies by plan, state, and individual circumstances. Any references to accepted plans or coverage are informational and subject to verification. We verify benefits and authorizations before therapy begins; eligibility is not guaranteed by the Site.

5. Applications, Forms & Electronic Communications

Information you submit must be accurate and complete. Electronic communications with us are governed by our Electronic Communications Policy and Privacy Policy. Do not use Site forms or email for medical emergencies.

6. Acceptable Use

You agree not to misuse the Site, including by: violating law; infringing others’ rights; uploading malicious code; attempting to gain unauthorized access; scraping or harvesting data; or interfering with the Site’s operation or security.

7. Intellectual Property

The Site and its content (text, graphics, logos, and software) are owned by or licensed to Forta and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission, except as permitted for personal, non-commercial use.

8. Third-Party Links & Services

The Site may link to third-party websites and services we do not control and are not responsible for. Your use of them is at your own risk and subject to their terms.

9. Disclaimer of Warranties

The Site is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the fullest extent permitted by law, Forta and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Site. Nothing in these Terms limits liability that cannot be limited under applicable law. This Section concerns use of the Site and does not limit any rights or remedies you may have with respect to clinical services under applicable law or a Service Agreement.

11. Indemnification

You agree to indemnify and hold harmless Forta and its affiliates from claims arising out of your breach of these Terms or misuse of the Site, to the extent permitted by law.

12. Dispute Resolution by Binding Arbitration; Class Action Waiver

Binding Arbitration. You and Forta agree that any dispute, claim or controversy arising out of or relating to these Terms, or the breach, termination, enforcement, interpretation, or validity thereof (collectively, “Disputes”), will be resolved solely by binding, individual arbitration, and not in a court of law. You acknowledge and agree that you and Forta are each waiving the right to a trial by jury. The arbitration shall be administered by the American Arbitration Association (“AAA”) in accordance with its Commercial Arbitration rules. The Federal Arbitration Act will govern the interpretation and enforcement of this Section. The arbitrator’s decision will be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

Class Action Waiver. You and Forta agree that each may bring claims against the other in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. Further, unless both you and Forta agree otherwise in writing, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.

13. Termination

We may suspend or terminate your access to the Site at any time for any reason, including violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules.

15. Changes

We may update these Terms. Changes are effective when posted with a new effective date. Continued use of the Site means you accept the updated Terms.
